Moving to the USA? Why would a green card application be denied?

  • March 19, 2021

America is a land of immigrants, and immigration is critical to our economy. Immigrant workers hold many jobs in the home healthcare industry, farming industry, and in the area of technology. The children of immigrants have been proven to be very upwardly mobile.

Despite this, politicians have made it difficult to immigrate to the United States. The U.S. Citizenship and Immigration Services in the United States Consulate in a person’s country of origin make decisions on green cards. There are a few different reasons why a green card application may be denied.

The Administrators Sometimes Make Mistakes

The workers in the United States consulate and the USCIS are human and are just as prone to error as any of us. They may get your birthday wrong and have a hard time verifying that you were born in the country that you say you were. They may even misappropriate your filing fee and think that you have never paid it. this is one of many reasons that it is very important to have a competent immigration lawyer on your side.

You Have a Criminal Record

If you have a criminal record either in the United States or your country of origin, you may be denied a green card. They will take the severity of the crimes into consideration. They will also look at the frequency of these crimes. If you have been convicted of anything violent or had anything to do with drugs or prostitution, there’s a very good chance your application won’t go through.

You Make Mistakes on Your Application

If you neglect to put certain information into your application or you do not pay a fee, your application will be denied. It is extremely important to fill out your forms thoroughly. It is never a good idea to apply for a green card without the assistance of a professional attorney.

A lawyer will have filled out hundreds of these forms and know exactly what information needs to be provided. You must also provide them with all the documentation that they require if you want an application to be successful.

You are Considered to Be a Potential Terrorist

If you have ever been involved in an organization that is considered a threat to the United States, you may be denied a green card. If you participated in any political or religious organizations that are considered to be radical or to mobilize terrorists, you may be under suspicion for espionage and therefore denied a green card.

Your Visa Petition is Denied

When you apply for a green card, you generally do so if you are a family member of a citizen or if you are seeking employment in the United States. In some cases, you may be an investor who puts a considerable amount of money into a United States business.

If you are moving to America to be with your family or to get a job, someone will have to sponsor you. They will do this by filling out a petition for a Visa. If that petition is denied, your green card application will be canceled.

Providing the USCIS with all the information they request and filling out your forms correctly will give you a much better chance of being approved. If you are denied, don’t give up hope. You can appeal their decision in most cases.
