What Should You Do if You Are Injured While Out of State or on Vacation?

Vacations are a time of freedom and relaxation. Some people carefully plan their vacations to ensure that nothing terrible happens. Unfortunately, accidents can happen at any time. Being injured while you are out of state or on vacation can cause complications, and you might not know what to do.

Due to the various jurisdictions over which different courts have authority, establishing which state you can sue is essential.  

Regardless of the accident’s location, the compensation claim process is the same. Starting with contacting the authorities immediately after the accident, gathering vital information about the circumstance, contacting a personal injury lawyer, and filing insurance claims.

Involve the Authorities 

The first thing you should do immediately after an accident is to dial 911 and request police assistance and an ambulance. The police officers will analyze the accident scene and write a police report which will be helpful in court in case you have to sue for compensation. Seeking medical attention as soon as you can is essential, even if you think you are not hurt. You could be having an adrenaline rush which masks the pain. Instead, being checked by a medical professional will prevent potential consequences and help your compensation claim later.

Document the Accident Scene

If your injuries are not severe, take photographs of the accident scene. Capturing the entire scene will help your case by gathering all the necessary details to establish the accident’s circumstances. Suppose you sustained injuries because of a car or truck accident. In that case, you should exchange information such as full name, address, license plate number, insurance company, and insurance policy number with the other driver. 

Most of the time, some eyewitnesses are at the scene of the accident. Gathering their testimonials can be helpful to your case. If your injuries are severe, make sure to collect contact information so that you can gather all the information at a more convenient time. This information is necessary both in your state and in the state in which the accident happened. 

Give Notice to Your Insurance Company

Contacting your insurance company to tell them that you were involved in a car accident is essential in filing a compensation claim. If you travel in the United States, making a compensation claim to your insurance company should not be an issue. If you are traveling out of the country, you might have travel insurance. In this case, you must contact the company providing the services. If you were using a rental car at the time of the accident, you must contact the rental company. 

Some car rental companies offer insurance protection while you are using the car. As long as you accept that coverage, filing a claim form with them will be sufficient. Although the process of claiming compensation for your out-of-state accident is seemingly similar, the distance and the involvement of various authorities can complicate the case. Having a lawyer by your side in such a difficult time can be helpful. A certified attorney will know exactly what steps to take so that you can receive proper compensation for your financial losses.
